<u>Étape 1 : Vérifiez si la photographie contient une œuvre originale</u>
• sur la voie publique il peut y avoir des éléments qui sont protégés par le droit d’auteur si leur originalité peut être démontrée. Ce sont, par exemple, des œuvres de l’esprit comme les architectures, le mobilier urbain, les sculptures, les affiches, etc.

<u>Étape 2</u> : Si c’est le cas, l’auteur d’une œuvre originale doit donner son accord pour qu’elle soit photographiée et diffusée en ligne.
Attention : Il existe une exception, si la photographie tombe dans l’exception de panorama, c’est le cas dès lors que :
• le photographe est une personne physique qui agit <b>en son propre nom</b> – et non celui d’une organisation qu’elle soit publique ou privée ;
• les œuvres représentées sur la photographie sont des architectures et des sculptures qui sont présentes <b>en permanence</b> sur la voie publique ;
• les photographies <b>ne font pas l’objet d’un usage commercial</b>;
• Si vous respectez ces trois conditions, alors vous pouvez diffuser la photo sur Panoramax, sans l’accord de l’auteur.
